1. Agreement to Terms

By accessing or using PickedByAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. You must be at least 18 years old to use this Service.

2. Description of Service

PickedByAI provides AI visibility audits that analyse how artificial intelligence platforms (such as ChatGPT, Claude, Perplexity, Gemini, and Google AI Overview) perceive and recommend businesses. Our service generates reports based on queries to these AI platforms and provides recommendations to improve AI visibility.

3. Free and Paid Services

Free Audit: A one-time audit with a basic visibility score across a limited number of AI platforms.

Agency Subscription: Ongoing weekly visibility monitoring across multiple AI platforms with deliverables, branded reports, and client management tools. Pricing is agreed individually during onboarding.

We reserve the right to change the features included in each tier. Subscribers will be notified of material changes to their plan.

4. Payment and Cancellation

Payment is processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

Subscriptions are billed monthly in advance. You may cancel at any time and your access will continue until the end of the current billing period. No refunds are provided for partial months.

For free audits, no payment is required. Due to the nature of the service (instant digital delivery), we do not offer refunds once an audit has been generated. If you experience technical issues preventing delivery of your report, please contact us at hello@pickedbyai.co.uk within 7 days.

5. Accuracy and Limitations

AI Responses May Vary: Our audits are based on AI responses at the time of generation. AI platforms regularly update their models and knowledge, so responses may differ if you check independently or at a different time.

No Guarantees: We do not guarantee that following our recommendations will result in improved AI visibility. Results depend on many factors outside our control, including changes to AI platform algorithms.

Advisory Only: Our reports are for informational purposes only and should not be considered as professional marketing, legal, or business advice.

6. User Responsibilities

You agree to:

Provide accurate business information
Use the Service only for lawful purposes
Not attempt to abuse, overload, or manipulate the Service
Not use automated systems to access the Service excessively
Not share login credentials with unauthorised parties

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by PickedByAI and is protected by copyright, trademark, and other intellectual property laws.

Your audit reports and deliverables are licensed to you for your own business use. Agency subscribers may share reports with their clients as part of their service offering. You may not resell or publicly redistribute the PickedByAI platform itself.

8. Limitation of Liability

To the fullest extent permitted by law, PickedByAI shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Damages arising from your reliance on the Service
Damages exceeding the total amount paid by you to us in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time. For paid subscribers, we will provide reasonable notice of any material changes or discontinuation and offer a pro-rata refund for any unused subscription period.

10. Third-Party Services

Our Service relies on third-party AI platforms (OpenAI, Anthropic, Google, Perplexity). We are not responsible for the availability, accuracy, or policies of these third-party services. Changes to their services may affect our Service.

11. Complaints and Disputes

If you have a complaint about the Service, please contact us at hello@pickedbyai.co.uk. We will acknowledge your complaint within 5 working days and aim to resolve it within 30 days.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date above. Your continued use of the Service after changes constitutes acceptance of the new Terms.
